The Americans with Disabilities Act (ADA) of 1990 provides a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities, and to bring persons with disabilities into the economic and social mainstream of American life.
The City of Long Beach is committed to complying with both the intent and spirit of the ADA. The City of Long Beach does not discriminate on the basis of disability in employment or in admission to, access to, or operations of its programs, services, or activities. Jennifer Kumiyama, Citywide Accessibility Coordinator, has been designated to coordinate and carry out the City's compliance with the nondiscrimination requirements of Title II of the Americans with Disabilities Act. PUBLIC NOTICE
NOTICE UNDER THE AMERICANS WITH DISABILITIES ACT
In accordance with the requirements of Title II of the Americans with Disabilities Act ("ADA"), the City of Long Beach will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities.
Employment: The City of Long Beach does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the ADA.
Effective Communication: The City will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in the City’s programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.
Modifications to Policies and Procedures: The City of Long Beach will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services, and activities. For example, individuals with service animals are welcomed in City of Long Beach facilities, even where pets are generally prohibited.
Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City of Long Beach, should contact the Citywide Accessibility Coordinator as soon as possible but no later than 48 hours before the scheduled event.
The ADA does not require the City of Long Beach to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.
Complaints that a program, service, or activity of the City of Long Beach is not accessible to persons with disabilities should be directed to the Citywide Accessibility Coordinator.
The City of Long Beach will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy.

GRIEVANCE PROCEDURE
Policy
It is the policy of the City of Long Beach not to discriminate on the basis of disability. The City of Long Beach has adopted an internal grievance procedure providing for prompt and equitable resolution of complaints alleging any action prohibited by Section 202 of the Americans with Disabilities Act of 1990 (42 U.S.C. 12132) or Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794), and their implementing regulations. Section 202 states, in part, that “no qualified individual with a disability shall, by reason of such disability, be excluded from participation in or be denied the benefits of services, programs, or activities of a public entity, or be subjected to discrimination by any such entity.” Section 504 prohibits discrimination on the basis of disability in any program or activity receiving Federal financial assistance.
Any person who believes she or he has been subjected to discrimination on the basis of disability may file a grievance under this procedure. It is against the law for the City of Long Beach to retaliate against anyone who files a grievance or cooperates in the investigation of a grievance.
To be protected under the ADA of Section 504, one must have a disability or have a relationship or association with an individual with disability. An individual with a disability is defined by the ADA as a person who has a physical or mental impairment that substantially limits one or more major life activities. This includes people who have a record of such an impairment, even if they do not currently have a disability. It also includes individuals who do not have a disability but are regarded as having a disability.
Procedure:
Grievances must be submitted to the Citywide Accessibility Coordinator within 60 calendar days of the date the person filing the grievance becomes aware of the alleged discriminatory action:

Long Beach, CA 90802The grievance must be in writing or, when requested as an accommodation, in another format that accommodates the complainant’s disability. The grievance shall contain the following:

Name, address, and phone number of the person filing the grievance;

Statement of the problem or action alleged to be discriminatory; and
-
Statement of the remedy or relief sought.
You may also fill out this grievance form and submit it.
The Citywide Accessibility Coordinator (or her/his designee) shall conduct an investigation of the grievance. This investigation may be informal, but it must be thorough, affording all interested persons an opportunity to submit relevant evidence.
The Citywide Accessibility Coordinator will issue a written decision on the grievance no later than 30 calendar days after its filing. The written decision will include instructions for appealing the decision.
The person filing the grievance may appeal the decision of the Citywide Accessibility Coordinator by writing to the deputy city manager of the City of Long Beach within 15 calendar days of receiving the Citywide Accessibility Coordinator’s decision. The deputy city manager of the City of Long Beach shall issue a written decision in response to the appeal no later than 15 calendar days after its filing, which shall be the final decision of the City of Long Beach.

CITIZEN'S ADVISORY COMMISSION ON DISABILITIES
OUR PURPOSE
The Citizen's Advisory Commission on Disabilities's (CACoD) purpose is to advise the Mayor, City Council and City Manager on the concerns and issues affecting people with disabilities in the community.
WHO WE ARE
CACoD consists of community members from the City of Long Beach and representatives from public and private agencies, which provide services to disabled citizens within the City. The commission is composed of a total of 9 members, all appointed by the Mayor of Long Beach and confirmed by the City Council.

CACOD serves anyone having a physical or mental impairment, which substantially limits functioning in one or more major life activities, or a person who has a record of such impairment. A "life activity" is defined as any mental or physical function or activity, which creates a substantial barrier to such things as employment, housing, transportation, recreation, or health services.
WHAT WE DO

Act in an advisory capacity to the Mayor, City Council and City Manager;

Assemble information on issues affecting people with disabilities in the areas of employment, health services, housing, transportation, and recreation, and other life activities;

Recommend ways to eradicate artificial barriers to a full and productive life for people with disabilities;

Facilitate coordination between existing and proposed programs for persons with disabilities;

Carry out studies as assigned by the City Council.
