Return-to-Work
What We Do:
The primary role of the Return-to-Work Division is to assist Departments with engaging employees with medical work restrictions in the interactive process to explore reasonable accommodations that will help them perform their essential job duties in compliance with the Americans with Disabilities Act (ADA), Fair Employment & Housing Act (FEHA), and Pregnant Workers Fairness Act (PWFA). The facilitation of the interactive process also includes exploring reasonable accommodations for religious exemption requests in compliance with Title VII of the Civil Rights Act of 1964.
Additionally, personnel staff are available to assist Departments with inquiries on leave administration i.e., CFRA/FMLA, Extended Leave of Absence, Paid Parental Leave, Pregnancy Disability Leave, Temporary Disability Leave, Catastrophic Leave, etc. Staff also assist on an employee’s application for disability benefits through The Standard or disability retirement through CalPERS and provide status updates regarding the employer portion of the employee application.
Mission:
The mission of the Return-to-Work Division is to ensure compliance with state and federal laws and city policies that streamline the good-faith interactive process essential to reducing chronic absenteeism and successfully retaining diverse and talented employees in the workplace. The Division also helps injured employees navigate disability insurance claims and disability retirement processes.
